Proposed Late Night Levy for takeaways 3rd January 2019

It has been reported that the Government will launch a consultation on the ability of councils to introduce levies for late night refreshment venues.

There are existing provisions in the Policing and Crime Act 2017 that would amend the late night levy provisions first introduced in the Police Reform and Social Responsibility Act 2011, namely:

1.    That the geographical extent of a levy can be applied to only part of a local authority’s area; and
2.    Levies can be adopted for late night refreshment licences.

It has been reported that, in its response to the House of Lords’ select committee report on the Licensing Act 2003, the Government said that “…we will consult on the level of charge appropriate for late night refreshment premises and will not commence the measure to allow licensing authorities to charge the levy to late night refreshment premises until this is completed.”

The consultation is expected in the Spring.
