The Health Protection (Coronavirus, Restrictions) (Obligations of Hospitality Undertakings) (England) Regulations 2020 Published Date: 17/09/2020

These Regulations require certain undertakings in the hospitality industry, to take measures to ensure that their customers follow the rules on social distancing. The Secretary of State must carry out a review of the need for the requirements in these Regulations within the period of six months of their coming into force.

This instrument enshrines the ‘Rule of Six’ in law under regulation 2.  Regulation 3 creates an offence for “a person who without reasonable excuse contravenes a requirement in regulation 2.”

Regulation 4 empowers regulators to issue a fixed penalty notice for an offence under the Regulation.

Designations

Regulation 8 designates authority to “a person who is designated for the purposes of regulation 9(13) or 10 of the Principal Regulations is to be treated as if they were designated” for the purposes of this regulation.
